THE charge sheet filed by J and K Police’s Crime Branch on abduction, rape and murder of eight-year-old Asifa Bano in Kathua district is a chilling exposure of an unspeakably horrific crime combined with ugly form of communal politics. It has heightened the feeling of vulnerability among the Bakherwal nomadic community. She was missing in Rasana village since January 10. On January 17, her mutilated body was found, bearing marks of gang rape. The local lawyers tried to prevent the police from filing the charge sheet. The Jammu High Court Bar Association called for a bandh on 11th April demanding handing over of investigation to CBI. All these were to stop the police’s investigation that has led to the arrest of eight men, including the temple chief and two policemen charged with destroying evidence.

The BJP-PDP state government shamelessly compromised with the perpetrators of the crime even when people were protesting in Kathua for months. A RSS-floated organization, Hindu Ekta Manch, too held protests and two BJP state ministers were present at a rally in support of the accused. Following what happened to Gujjar-Bakherwal community’s sense of isolation has heightened amid threats to evict them from their traditional camping sites in forests. Motivation for her abduction and assault was to instill fear for driving out the nomads and to deprive their rights to the forests and commons. The rape was a deliberate plan to terrorise them to leave the area. The Bakherwals and the Gujjars, recognised as Scheduled Tribes, are Muslim by belief. The child was raped, going by the chargesheet, because she was a Muslim.

This gruesome communal fascist act calls for investigation to punish the culprits of the hate crime against Asifa— along with the Unnao rape of a minor girl by a BJP MLA and his friends in U.P., in which the victim’s father was killed in police custody. These and numerous other attacks on women and children show how the ruling system is becoming increasingly loaded against all the oppressed including women, dalits, adivasis and minorities.

The blatant communalisation of cases of sexual assault has very serious implications. If ‘Nirbhaya’ had happened to be Muslim, the streets of Delhi would have been filled not with young people demanding justice, but with Hindu Ekta Manch supporters protesting against the arrest of Hindus?

In Unnao a 17-year-old tried to file a case of rape against a BJP MLA for rape which took place last June. But in spite of all her efforts, the police refused to file an FIR against the MLA. She was forced to stage a protest before the Chief Minister’s house, but even that made no difference. On the contrary, the girl and her family were harassed. Her father was killed in police custody. She was traumatised, humiliated and her father arrested and killed because she had dared to make a complaint against a powerful man, backed by the Chief Minister. This is enough to discourage any complaints of sexual harassment against men with powerful connections. It was only after mounting public outrage that the MLA’s brother has been arrested for her father’s death and an FIR filed against the MLA.It was only after Allahabad igh Court intervened he is taken in to custody for questioning.

In Kathua and Unnao cases, the BJP leaders and Sangh Parivar came out in support of those accused of rape. From “gau rakshaks” to “rapist rakshaks”, Sangh Parivar is coming out in ugliest communal fascist forms. Nobody can/should remain silent when such things are intensifying day by day. 
